Terms of Use

1. Accepting these terms

These Terms of Use (“Terms”) are an agreement between you and Dr. Elham Zandvakili (“we”, “us”), who operates the EZ Model website, games, apps, and learning platform (“the Service”). By using the Service or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who may use the Service

• You must be at least 13 years old to create an account.
• If you are between 13 and 17, you may use the Service only with the involvement of a parent, guardian, or school.
• You must be able to form a binding contract, and not barred from using the Service under applicable law.

3. Your account

• Give accurate information when you register, and keep it current.
• Keep your password confidential. You are responsible for activity under your account.
• Tell us promptly at dr.ez.model@gmail.com if you suspect unauthorised access.
• Do not share an account, or use someone else's.
• You may ask us to delete your account at any time.

4. Acceptable use

Please use the Service for learning and teaching. You agree not to:

• Break the law, or infringe anyone's rights, including copyright and privacy.
• Upload or submit unlawful, harassing, hateful, threatening, or sexually explicit material.
• Post another person's private information without their permission.
• Attempt to access accounts, data, or systems that are not yours.
• Probe, scan, or test the security of the Service, or bypass its access controls or rate limits.
• Interfere with the Service, including by overloading it or introducing malicious code.
• Scrape or harvest content or data at scale, or use automated systems to extract them.
• Copy, resell, sublicense, or commercially redistribute the Service or its materials.
• Reverse engineer any part of the Service, except where the law expressly permits it.
• Misrepresent who you are, or your affiliation with any person or institution.

5. Your content

You keep ownership of what you create — your writing, recordings, reflections, and other submissions (“Your Content”).

By submitting Your Content you grant us a limited, non-exclusive, royalty-free licence to store, display, and process it solely to operate and improve the Service for you. This licence ends when you delete the content or your account, except for copies we must keep by law or in routine backups.

We will not publish Your Content publicly without your permission. Where a feature invites sharing — such as the reflection form — we ask for that permission separately, and you may decline.

You confirm you have the rights to what you submit, and that it does not infringe anyone else's rights.

6. Our content & intellectual property

The Service and its materials — including the books, songs, recordings, stories, lessons, games, diagrams, text, and design — are owned by Dr. Elham Zandvakili or licensed to her, and are protected by copyright and other laws. The Meta-Self Learning Model™ and related marks are claimed as trademarks.

What you may do: use the materials for your own learning, and — if you are an educator — in your own classroom teaching, with attribution and without charge.

What you may not do: sell them, publish them as your own, remove attribution, or distribute them commercially, without written permission.

If you believe something here infringes your copyright, write to dr.ez.model@gmail.com identifying the work, where it appears, and your contact details, and we will review it promptly.

7. AI features

The Service includes AI-assisted features such as the AI Tutor and voice practice. You agree that:

• AI output can be inaccurate, incomplete, or misleading, and must not be relied on as professional, medical, legal, financial, or academic advice.
• You will not submit sensitive personal information to these features.
• Your messages are sent to an external AI provider to generate a response — see the Privacy Policy.
• If you use AI output in coursework, you remain responsible for following your institution's academic-integrity rules.

8. Course use & grades

Where the Service is used alongside a course, optional features — newsletters, reflections, research participation — are never a condition of your grade or standing. Your instructor and institution remain responsible for assessment. Nothing here creates an obligation on any college or district.

9. Third-party links and services

The Service links to third-party sites and services, such as Amazon for books and YouTube for videos. We do not control them and are not responsible for their content, products, or privacy practices. Their terms apply when you use them.

10. Availability

The Service is offered free of charge and provided as it is, when it is available. We may change, suspend, or discontinue any part of it — including games, apps, and content — at any time, without notice. We do not promise uninterrupted or error-free operation, and we do not guarantee that data you store will never be lost. Please keep your own copies of work that matters to you.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Educational materials here are for general learning. They are not professional advice, and no teacher–student, therapeutic, medical, or professional relationship is created by using the Service.

The yoga, breathing, and movement content is not medical advice. Take part only within your own comfort and ability, and consult a qualified professional before starting any physical practice. You take part at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits, lost data, or loss of goodwill, arising from or relating to your use of the Service — whether based in contract, tort, negligence, or any other theory, and even if we were advised such damages were possible.

Where liability cannot lawfully be excluded, our total aggregate liability arising from or relating to the Service is limited to one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold harmless Dr. Elham Zandvakili from any claims, damages, losses, and reasonable legal fees arising out of your misuse of the Service, your breach of these Terms, or your infringement of anyone's rights.

14. Suspension & termination

We may suspend or terminate access if these Terms are breached, if it is necessary to protect the Service or its users, or if required by law. You may stop using the Service and request deletion of your account at any time. Sections that by their nature should survive — including sections 5, 6, and 11 to 13 — continue to apply after termination.

15. Governing law & disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Sacramento County, California — except that either party may seek injunctive relief where appropriate, and consumers may retain the right to bring proceedings in their country of residence where local law requires.

Please contact us first: most issues can be resolved informally.

16. Changes to these terms

We may update these Terms as the Service develops. We will revise the “Last updated” date, and for significant changes we will give notice on the site. Continuing to use the Service after a change means you accept the updated Terms.
